Spikato Privacy Policy

This Privacy Policy explains how Spikato ("Spikato", "we", "our", or "us") collects, uses, shares, and protects your information when you use our mobile application and website (together, the "Service"). Spikato is developed and operated by an independent developer based in Edmonton, Alberta, Canada.

By using the Service, you agree to the practices described here. If you do not agree with this Policy, please do not use the Service.


1. Who We Are

Spikato is an English-learning app that offers AI-powered chat, live practice calls, and pronunciation tools to help you improve your speaking skills.

2. Information We Collect

We collect information in three main ways: information you provide, information collected automatically, and information from third-party services.

2.1 Information You Provide

Account Information
Email address and password when you create an account, or limited profile information if you sign in with Google.

Profile and Learning Preferences
Your name (if provided), English level, goals, interests, lesson preferences, and avatar or AI companion choices.

Learning Activity and Content
Messages you send in chat, text from practice exercises, and transcripts from live or AI-powered calls. We use this to provide conversation history, generate feedback, and personalize your learning path.

Support Requests
Information you include when you contact us, such as your email address, device type, and a description of your issue.

2.2 Usage and Device Information

When you use the Service, we automatically collect:

Device Information
Device type, operating system, app version, language, device or other identifiers, and basic device settings.

Usage and App Activity
How you interact with the app (screens viewed, features used, session duration, app interactions), error and crash data, and rough time and date of use.

Notification Identifiers
Push notification tokens so we can send daily reminders and important service updates, if you enable notifications.

2.3 Audio and Voice Data

When you use voice features, we process:

Microphone Input and Voice Recordings
Audio from pronunciation practice and live or AI-powered calls so we can provide speech recognition, text-to-speech, real-time communication, and feedback.

Where possible, audio is processed in real time via our providers and not stored longer than needed. If audio is stored temporarily (for example, to enable playback or feedback), it is kept only for a short period and then deleted.

2.4 Payment and Purchase Information

We do not collect or store your full payment card details. Purchases (subscriptions or minutes) are processed by the Apple App Store or Google Play Store.

We do store limited information to manage your access:

  • Subscription status (active, cancelled, expired)
  • Minute balances and usage for calls
  • Purchase history and transaction references from the app stores

3. How We Use Your Information

We use the information we collect to:

  • Create and manage your account and authenticate you
  • Deliver personalized lessons, chat scenarios, and practice sessions based on your level and goals
  • Provide AI chat, live calls, pronunciation analysis, and feedback reports
  • Track your learning progress (completed lessons, streaks, time spent) and unlock achievements
  • Enforce free-tier limits, paid plans, and usage of purchased minutes
  • Send daily reminders and other notifications you opt in to
  • Diagnose problems, fix bugs, and improve app performance and features
  • Protect the security and integrity of the Service and prevent fraud or misuse
  • Comply with legal obligations and enforce our Terms

We do not sell your personal information to advertisers or data brokers.


4. How We Share Your Information

4.1 Third-Party Service Providers

We use trusted third-party providers to help us run the Service. These providers process data on our behalf to:

  • Host our backend, databases, and storage
  • Provide user authentication and push notifications
  • Power AI language processing and speech processing (speech-to-text and text-to-speech)
  • Provide crash reporting and basic analytics
  • Enable real-time communication infrastructure

We only share the information needed for them to provide their services, and they are contractually required to protect it.

We may disclose information when we believe it is reasonably necessary to:

  • Protect the rights, property, or safety of Spikato, our users, or others
  • Detect, prevent, or address fraud, security, or technical issues

4.3 Business Transfers

In connection with a merger, acquisition, financing, or sale of assets, your information may be transferred. We will take reasonable steps to ensure the successor honors this Privacy Policy or provides you with notice of changes.

4.4 Aggregated or De-Identified Data

We may share aggregated or de-identified information that cannot reasonably be used to identify you (for example, statistics about lesson completion rates).


5. Data Retention

We keep your information only as long as necessary to operate the Service, comply with legal obligations, resolve disputes, and enforce our agreements.

Account and Profile Data
Kept while your account is active. If you delete your account, we delete or anonymize this data unless we must keep some for legal, security, or accounting reasons.

Learning Progress and Content
Kept while your account is active so we can show your history, statistics, achievements, and feedback. Some aggregated or anonymized data may be kept to improve the Service.

Audio and Voice Data
Processed during your sessions and, where stored, kept only for the time needed to enable features (playback, feedback), then deleted or anonymized.

Purchase History and Transaction Records
Kept as long as necessary for accounting, dispute resolution, and legal requirements.

Crash Logs and Usage Data
Kept for a limited time to diagnose issues and improve the Service.

Support Communications
Kept for a reasonable time to manage support history and improve the Service.


6. Your Rights and Choices

6.1 Managing Your Information

Within the app, you can:

  • View and update profile, level, preferences, and learning settings
  • Change notification settings
  • Adjust permissions (microphone, notifications) via your device settings

6.2 Access, Correction, and Deletion

Access
You can request information about the personal data we hold about you.

Correction
You can update profile information in the app or ask us to correct inaccurate data.

Account and Data Deletion
You can delete your account and associated personal data:

In the app:
Go to Profile → Danger Zone → Delete Account (or equivalent setting). After you confirm, we will permanently delete your account and personal data, except for data we are required or permitted to retain for legitimate reasons (legal, security, billing records).

Outside the app (web or email):
If you cannot access your account, you can request deletion by:

  • Emailing us at: privacy@spikato.app with the email address associated with your account

Account deletion means deletion of associated user data, subject only to limited retention where needed for legal or security reasons.

Portability
You may request an export of your key account and learning data by contacting us. We will provide it in a reasonable format where feasible.

We may ask you to verify your identity before fulfilling these requests.

6.3 Notifications and Permissions

  • You can turn push notifications on or off in the app and in your device settings
  • You can withdraw microphone and other permissions at any time via your device settings (some features will not work without them)

7. Data Security

We take reasonable technical and organizational measures to protect your information:

  • All user data is encrypted in transit using industry-standard TLS
  • Access controls and authentication to limit data access
  • Secure hosting with reputable providers
  • Regular security updates

However, no method of transmission over the internet or electronic storage is completely secure. We cannot guarantee absolute security.


8. Children's Privacy

The Service is intended for users aged 13 and older. We do not knowingly collect personal information from children under 13.

If we learn that a child under 13 has provided personal information, we will delete it as soon as reasonably possible.

If you are a parent or guardian and believe your child has provided us with personal information, please contact us at privacy@spikato.app.


9. International Transfers

Our servers and some of our providers may be located in countries other than your own, including the United States. By using the Service, you understand that your information may be transferred to and processed in these locations, which may have different data protection laws than your country of residence.

We rely on appropriate safeguards where required and use reputable providers.


10. Changes to This Policy

We may update this Privacy Policy from time to time. When we do, we will change the "Last updated" date at the top. If we make significant changes, we may notify you within the app or by email.

Your continued use of the Service after the updated Policy becomes effective means you accept the changes.
